There are many facets to this precept.

CUSTODIAL PARENT RELOCATES:
It is pertinent they go through the court first. The parent can not just leave unless the other parent agrees and has no visitation rights.

CUSTODIAL PARENT IS MOVING OUT OF STATE:
If the parent with custody desires to move/in the process without the consent of the non-custodial parent, through a petition of court can delay that and come to agreements upon the visitation rights. It is suggested that these issues are dealt with outside of court1.

If the divorce took place in one state and the parent has already moved the children to another state, it can be taken to court. Though, if the parent and child have lived there for a umber of years, it may be denied.

RELOCATING WITHOUT CONSENT:
Moving away with the child for a time over 48 hours without the consent of the other parent can be considered parental kidnapping. With that, the parent that does not have the children should immediately confer with their lawyer and have a court order for the child to be return to the County of residence2.
